With reference to the section 159 of Indian Patent act 1970, the central government shall make rules for carrying out the purpose of the act. Both, patent act and patent rules are being amended over the years to meet the global qualities and standards, in grating a patent. Further, Indian Patent office takes sufficient precaution to update both Patent act and Patent rules.
The patent rules mainly concentrate and covers actions/period of actions/measures/procedures to be followed by any natural person or non natural person, who is both significantly or hardly associated to any communication with the Patent office.
Government of India notifies these amendments through a draft of patent act or rules. The draft patent act/rules are notified to general public through official gazette. Now, the patent office has published the draft patent (amendment) rules vide dated 29/10/2015. The Government of India also requests to respond for the draft patent act/rules with valid suggestions/comments.
The suggestions/comments shall be posted to patent office till the completion of one month from the subject notification.
Then, the government scrutinizes the suggestions/comments received from public and accordingly modifies the draft version of patent act/rules. Further, the final copy of draft takes immediate effect upon passing the bill in the parliament.
